In a 1998 article, Bohman argued that the contemporary deliberative turn in democratic theory had reached its ‘coming of age’, as deliberative democrats began to show greater interest in the institutionalization of their proposal. Moreover, Bohman referred to this growing interest with an expression that was unprecedented at the time: ‘deliberative constitutionalism’. At present, deliberative constitutionalism has become one of the most original and relevant contemporary proposals. In this context, my article proceeds as follows. I begin by arguing that the (...) contemporary deliberative turn in democratic theory also gave rise to a deliberative turn in constitutionalism—that is, a trend aimed at orienting constitutionalism and judicial review towards democratic deliberation. Next, I argue that, at that embryonic yet promising stage, deliberative constitutionalism had shortcomings that hindered the aim assumed since its origins. Finally, I argue that, over recent decades, these shortcomings have been finessed, which shows that deliberative constitutionalism has also reached its coming of age. (shrink)

El siguiente trabajo se propone analizar críticamente la concepción clásica y monológica de la imparcialidad del juez, su respectivo correlato institucional y las consecuencias para interpretar el vínculo que debería tener con los afectados. Para ello se realiza un análisis reconstructivo de El Federalista de Hamilton, Madison y Jay. En primer lugar, se analiza en tal documento el concepto de imparcialidad y sus supuestos teóricos. En segundo lugar, se señala el modelo constitucional derivado. The following work intends to critically analyze the classic and monological conception of the Judge´s impartiality, its respective institutional correlate and the consequences to understand the bond that should have with those affected. For this, a reconstructive analysis of The Federalist by Hamilton, Madison, and Jay is made. In the first place, the concept of impartiality and its theoretical assumptions are analyzed in such document. Second, it shows how, despite the turns and transformations of the "new constitutionalism", some of this assumptions remain applicable. Argumentation is a form of reasoning where a claim is accepted or rejected according to the analysis of the arguments for and against it; furthermore, it provides a reasoning mechanism able to handle contradictory, incomplete and uncertain information in real-world situations. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. En este trabajo nos proponemos exponer la importancia de la afectividad en la fenomenología francesa contemporánea de la mano de dos conceptos centrales del pensamiento de Henri Maldiney: lo transposible y la transpasibilidad. Además, nos esforzaremos en concretar y ahondar en esta cuestión atendiendo a la experiencia del duelo, esto es, la pérdida del otro como acontecimiento afectivo. Para ello recurriremos a algunas ideas de Claude Romano, pero también, y a modo de situación descriptiva, a los testimonios literarios de la (...) escritora y periodista Joan Didion y del escritor C.S. Lewis. La experiencia del duelo se mostrará, así, como un caso ejemplar en el que el existente es afectado por los acontecimientos. This essay explores the contact between the Italian and Argentine cultures during the period of mass immigration by pointing out and commenting on a series of translations and artistic creations made by Italian artists in Buenos Aires: musical, literary, theatrical and pictorial works. In order to understand how the semiotic frontier was composed, we approached the question from a methodology that arises at the intersection of the phenomenon of translation and the semiotic theory of cultural interaction. Thinking about translation in (...) this way highlights its sociological dimension given the links that the source-text establishes with the programs of certain trends in the organization of a culture. The methodology consists on the description of the semiotic frontier showing which texts are of interest to whom and for what. In this way, we seek to understand how a certain tendency was positioned in relation to the project of sustaining italianità in Buenos Aires at the end of the 19th Century. The path proposed shows the frontier between the Italian and Argentine cultures as a bilingual mechanism of mediation from which a cultural group of immigrants developed actions to propose the textual and metatextual guidelines of c. This report analyses the aplicability of the principles of consciousness developed in the ASys project to three of the most relevant cognitive architectures. This is done in relation to their aplicability to build integrated control systems and studying their support for general mechanisms of real-time consciousness. To analyse these architectures the ASys Framework is employed. This is a conceptual framework based on an extension for cognitive autonomous systems of the General Systems Theory (GST). Respect for human life is central to medicine. In terminal patients, refractory symptoms are a niche of palliative sedation. This paper identi es, based on scienti c evidence, the survival in patients who received palliative sedation as compared to those who didn’t. We conducted a search for systematic reviews from 2000 to 2016, which were methodologically analyzed, and the results were then compared. For methodological reasons, meta-analysis could not be performed. It is concluded that terminal palliative sedation does not shorten (...) patients’ lives. The implementation of the principle of double effect related to the possible shortening of life was reformulated; the unwanted evil is the loss of consciousness. (shrink)

Ernst Bloch formulated problems of enormous philosophical and human relevance. He held that in our contemporary situation we have but two questions concerning the fundamental direction of our lives and history: we must choose, first, between hopeless nihilism and transcendent hope; and, second, between transcendent hope with transcendence and transcendent hope without transcendence. Bloch opted for the transcendent hope without transcendence and formulated a hard critique of hope with transcendence. Josef Pieper and Bernard Schumacher have offered a competent response to (...) Bloch from the Catholic perspective. However, we offer here a little explored aspect of the problem by demonstrating that Bloch’s metaphysical arguments do not consider that (a) a material reality necessarily has the concrete potentiality of dissolving, and (b) therefore, left to itself, it will dissolve necessarily in infinite time; and that (c) no effect can have a reality disproportionate to its cause, which is the reason why (d) no immortal reality can proceed from mortal reality without the intervention of a higher cause. The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. AbstractDuring the last 20 years, the financial sector has undergone an unprecedented transformation due to new regulations and the implementation of several technological advancements. The combination of regulation and technology has brought about new financial processes that have fundamentally changed how financial market making is done. This paper studies the ethics of financial market making and its implications for one of the most controversial financial innovations of modern times, namely high-frequency trading (HFT). We claim that the Aristotelian distinction between natural (...) chrematistics, which is aimed at serving the real economy, and unnatural chrematistics, whose ultimate purpose is wealth accumulation, can be a useful criterion to assess the ethics of financial market making and the goodness of an innovation as HFT, and how it can serve the common good of society. Algunos de sus integrantes buscan aplicar al cine los planteos de F. R. Leavis y la revista Scrutiny (...) a propósito de la crítica literaria. Es esta modulación analítica la que será puesta en cuestión con el auge del estructuralismo y el posestructurailsmo a los que se asocia la revista Screen en los años 70.: During the sixties, the journal Movie inherits from Cahiers du cinéma the preferencies for a politique des auteurs and for certain american films. However, never abandoning this tendency towards a “cinema of directors”, the british journal develops a rigorous method of formal analysis and detailed close readings. Some of its members try to apply to cinema the concepts elaborated by F. R. Leavis and the journal Scrutiny in reference to literary criticism. Rawls no habría podido proveer una teoría de la justicia capaz de regular las relaciones internacionales, algo que otros pensadores rawlsianos (Beitz, Pogge) creyeron necesario. Este artículo intenta explicar las razones que impedían ese cometido. De una parte, el estrecho nexo entre la justicia, como una virtud, y la unidad política, solo en el contexto de la cual esa virtud tiene sentido. Al menos así lo ha entendido la tradición filosófica. De otra parte, las decisiones meta-filosóficas que Rawls toma y (...) su afán de hacer de la suya una teoría de la justicia "post-metafísica" y "estrictamente política". This article tries to explain why it was impossible for Rawls to develop a normative theory ofjustice for international relations; something that has been demanded by some rawlsian thinkers (Beitz, Pogge, etc.). There were two obstacles for such an enterprise. On one hand, the link established by the philosophical tradition between justice, as a political virtue, and the political unity (polis, national-state, etc.). This book examines the reactions of the friends and family of those who elect to die due to terminal illness. These surviving spouses, partners, relatives, and friends, in addition to coping with the death of a loved one, must also deal with the loved one's decision to die, thus severing the relationship. C. G. Prado examines how reactions to elective death are influenced by cultural influences and beliefs, particularly those related to life, death, and the possibility of an afterlife. It is the aim of this paper to trace, firstly, how far Epicurus is indebted to pre-Socratic physiology regarding the axiom of nihil ex nihilo, which the Samian philosopher accepts in toto; secondly to prove that physics, with this axiom as a ground, is a requisite for a both natural and mental framework where ἀταραξία can be achieved. In the first part of this writing, the aforementioned principle is presented as a struggle against myth, for a new interpretative structure of (...) the world. Afterwards, a path is defined, that goes from Parmenides and Melissus of Samos, as a necessary conceptual link, to the first ancient atomism. In the second part of this research effort, the role of atomistic materialistic physics is presented as an essential explanatory foundation for achieving, in the Epicurean way, a happy life without fear or mental disturbance. Accordingly, the study of nature, and the rational assumption of its conclusions, becomes a tool for soul care. (shrink)

This doctoral dissertation deals with the psychotherapeutic factor that permeates the whole Epicurean philosophical program. It is the aim of this study to research and to rehabilitate its healing function. Since the Garden’s philosophy is a very systematic one, the question about the natural reality, φύσις, had to be addressed firstly. Anti-nihilism, materialism, eternal atoms, infinite void, perpetual movement, clinamen and the plurality worlds are key notions of the axiomatic and scientific Epicurus’ physics. Once we had gained clarity about those (...) core concepts, the central role of human beings in the system was to be discussed. As natural, yet exceptional, atomic compounds, men and women do have flesh and soul and are, therefore, completely mortal. Nevertheless, they possess numerous qualities, originating in their ψυχή, which render them unique : freedom, rationality and even a material community with the gods. According to Epicurus, there is a fourth element constituting the souls of both people and deities, so that a physical continuity and material formation are preserved through the entire nature. Gods are studied from a naturalistic physiologic perspective and at the very same time they act exemplary and, freed from any providential, governing tasks, they provide a regula uitae in order to achieve a pleasant, authentic happiness. In fact, this research tries to demonstrate that complete curation is not to be linked to an eternal extra-corporeal soul, but arises from the removal of pain and fear, aponia and ataraxia. These two are the paramount pleasures, far distant from a gross hedonism. Ethics are, then, presented as a soothing practice, having a nuclear medical purpose. Taking this into account, it was necessary to explore the historical connections between philosophy and rational Hellenic medicine before Epicurus. After that, multiple therapeutic forms conceived or applied by the Samian philosopher were analyzed. The λόγος proved to be the unifying element among them and involved not only human reason but also analogy. Epicurus’ diagnose is very sad: we are in pain. To reverse that, he presented exercises such as meditation, confession, self-examination, laugh therapy, emotional intelligence, intrusive thoughts control, companionship, solidarity and friendship. There are still two additional therapies completing the above mentioned: an Epicurean thanatology, because we miss the point when considering (im)mortality and forget about sensation as the ground of any life; and an ars desidrandi, because we should accept only natural and necessary desires, instead of chasing whimsy dreams with vain hopes. All this will help us regain our primal bodily and mental health and happiness, our essential, frugal and glad wellbeing. By means of prudence and reflection, governing our body and cultivating our mind we will liberate ourselves and taste a durable, profound, stable joy, comparable to that of the gods. (shrink)
